Terms of Service

1. Acceptance of Terms

By accessing or using the website located at bodegaentertainment.com (the “Site”) and any services provided by DJ Bodega LLC (“DJ Bodega,” “we,” “us,” or “our”), including our online booking system, client portal, and entertainment services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to all of these Terms, you must not use our Site or Services. We reserve the right to modify these Terms at any time. Your continued use of the Site or Services after any modifications constitutes your acceptance of the revised Terms.

2. Description of Services

DJ Bodega provides professional disc jockey (DJ), emcee, lighting, photo booth, and related entertainment services for weddings, corporate events, private parties, quinceañeras, and other special occasions. Our Services include:

• Online event booking and package selection
• Electronic contract execution
• Secure online payment processing
• Client portal for event planning and communication
• On-site entertainment services as described in your selected package

Service availability is subject to date and location availability. All services are provided in accordance with the specific terms outlined in your Entertainment Service Agreement (the “Contract”), which is executed during the booking process.

3. Booking and Payment

Deposit

A non-refundable deposit of $500 is required to secure your event date. The deposit is due upon execution of the Entertainment Service Agreement. Your event date is not confirmed until the deposit has been received and the Contract has been signed.

Remaining Balance

The remaining balance of your total package price is due no later than thirty (30) days prior to your event date. Failure to remit the remaining balance by the due date may result in cancellation of services and forfeiture of the deposit.

Payment Methods

We accept credit cards, debit cards, and bank transfers (ACH) through our secure payment processor, Stripe, Inc. All payment transactions are encrypted and processed in accordance with PCI DSS standards. DJ Bodega does not store your payment card information on our servers.

Pricing

All prices listed on the Site are in US Dollars and are subject to change without notice. The price at the time of booking, as specified in your signed Contract, is the price that applies to your event.

4. Cancellation Policy

The following cancellation terms apply to all bookings:

• Deposit: The deposit is non-refundable under any circumstances.
• Cancellation within 30 days of event: The full remaining balance is due.
• Cancellation 30-60 days before event: 50% of the remaining balance is due.
• Cancellation more than 60 days before event: Only the deposit is forfeited.

All cancellation requests must be submitted in writing via email to [email protected]. The date of the written notice shall be considered the cancellation date.

In the event that DJ Bodega must cancel due to emergency, illness, or circumstances beyond our control, we will make every reasonable effort to provide a qualified replacement. If no replacement is available, you will receive a full refund of all amounts paid.

5. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, photographs, videos, audio, software, and the overall design and layout of the Site, is the property of DJ Bodega LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without our prior written consent, except for personal, non-commercial use.

The DJ Bodega name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of DJ Bodega LLC. You may not use such marks without our prior written permission.

6. User Conduct

When using our Site and Services, you agree to:

• Provide accurate and truthful information in all forms and communications.
• Use the Site and Services only for lawful purposes.
• Not attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems.
• Not use any automated means (bots, scrapers, etc.) to access or collect data from the Site.
• Not upload or transmit any viruses, malware, or other harmful code.
• Not interfere with or disrupt the operation of the Site or Services.
• Not impersonate any person or entity or misrepresent your affiliation.

We reserve the right to terminate or restrict your access to the Site and Services at any time, without notice, for any violation of these Terms.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DJ BODEGA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE SITE OR SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO DJ BODEGA UNDER YOUR ENTERTAINMENT SERVICE AGREEMENT.

The Site and Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify, defend, and hold harmless DJ Bodega LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Site or Services.
• Your violation of these Terms.
• Your violation of any rights of a third party.
• Any content or information you provide through the Site or Services.

9. Governing Law

These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Indian River County, Florida. You consent to the personal jurisdiction of such courts and waive any objections to venue.
